Termination of lease? we have a tenant that wants to leave early, please advise on wording of lease.? - landlord tenant lease termination
We've recently bought a commercial property with the tenants on the rent, the tenant wants to leave, but the wording of the lease is not in good English. Should we pay the rent because the lease term?, We can achieve some arraingment? Section on the termination is as follows.
5.15.1 The tenant may set the contract: --
5.15.1.1 any time, not less than seven days notice in writing to the owner
( "Notice") of receipt of notice in the door of the determination of the franchise agreement dated January 31, 2005, between the Porte and the name of the company * * and / or
5.15.1.2 the late completion of the second quarter of this agreement by the landlord at least three months prior written notice ( "Notice")
provided that described in paragraphs 5.15.1.1 and 5.15.1.2 above, the tenant has until the date of determination to pay the rent
5.15.2 At the end of the declaration referred to in paragraphs 5.15.1.1

There is something missing, we do not know when to apply the clause 5.15.1.2, which have given you. I think you should be able to break the lease anyway, in agreement with the tenant, but I strongly recommend you a lawyer in this case.
